Who will settle the US sports event contract question first: the CFTC, a state regulator or Congress?
Kalshi, Polymarket, Crypto.com and Robinhood offer sports event contracts under the CFTC's federal remit while state regulators in New Jersey, Nevada, Maryland, Ohio and others say they are sports betting and need a state licence. The CFTC has held roundtables and states have sued. This market asks who settles the question first with a final, published rule.
Resolution rule
Resolves to the CFTC if it publishes a final rule in the Federal Register specifically governing sports-related event contracts before 30 June 2027; to a state gaming regulator if a state adopts final regulations (not an advisory, cease-and-desist or emergency order) licensing or expressly permitting sports event contracts before that date and before the CFTC; to Congress if a federal statute addressing sports event contracts is signed into law first. If none happens by 30 June 2027, resolves to that option. Checked on federalregister.gov, state regulator sites and congress.gov.
