Self-Regulation Has Had Its Chance and Produced the Wrong Results

This is not a situation where voluntary codes were introduced and produced modest rather than dramatic improvements. It represents a channel that is growing rapidly while the regulatory framework remains focused on formats that are declining in relative importance. Any advertising reform that does not specifically address influencer marketing and the statutory obligations of online platforms will be out of date before it is implemented.
Timing Creates Both Opportunity and Complication for the Industry
The report lands at a moment when the UK gambling industry is already absorbing the shock of the Remote Gaming Duty hike, managing retail closures and navigating the consequences of Evoke's strategic difficulties. Adding the prospect of sweeping advertising restrictions to that mix creates a compounding pressure that smaller and more heavily UK-dependent operators will find particularly difficult to manage. Paradoxically, the same tax environment that is squeezing operators may make the government more cautious about implementing advertising restrictions that would further reduce industry revenues and therefore tax receipts. The Treasury's interest in maximising yield from the RGD hike creates a tension with the public health case for restricting promotion that politicians will need to navigate carefully. That tension does not make advertising reform less likely, but it does mean the shape and timing of any measures will be influenced by fiscal considerations as much as public health ones.
