North Fork's $725m Madera Casino Is Due to Open on 28 October as a Federal Judge Weighs Chukchansi's Challenge

North Fork's $725m Madera Casino Is Due to Open on 28 October as a Federal Judge Weighs Chukchansi's Challenge

Station Casinos and the North Fork Rancheria have set an opening date for their California casino while a motion to stop the gaming sits with a federal judge. The case turns on a governor's concurrence that California's courts say never had legal effect.

  • The North Fork Rancheria of Mono Indians says its $725 million casino off Highway 99 in Madera County will open at 12:01am on 28 October, managed by Station Casinos, a Red Rock Resorts subsidiary
  • US District Judge Kirk E. Sherriff heard the Picayune Rancheria of the Chukchansi Indians' motion for a preliminary injunction and stay, and motions to dismiss, on 9 October; the docket records an order to follow
  • Picayune asks the court to set aside the National Indian Gaming Commission (NIGC) chair's January 2024 approval of the management contract and to enjoin all unlawful gaming on the site, because California's courts have held the governor's 2012 concurrence void
  • Red Rock's latest 10-Q puts project costs at about $750 million, with a management fee of 30% of net income for seven years and a 4% development fee payable on opening
  • North Fork says earlier federal approvals settle the question; how a ruling against it would affect the opening is unclear, The Fresno Bee reports

A Built Casino, an Opening Date and a Motion Under Submission

The North Fork Rancheria of Mono Indians has announced that its casino on a 305-acre site north of the city of Madera will open at midnight on 28 October, according to the casino's website and a FOX26 report. FOX26 describes a $725 million property with more than 2,400 slots and 40 table games. G3 Newswire puts the gaming floor at 100,000 sq ft and the jobs at more than 1,500.

Red Rock Resorts' 10-Q for the quarter to 30 June describes approximately 2,000 Class III slot machines plus additional Class II machines and about 40 table games, at a total cost of approximately $750 million including design, construction, preopening, financing and development fees. Construction began in September 2024.

The case that could interfere is Picayune Rancheria of the Chukchansi Indians v. The Chair of the National Indian Gaming Commission, No. 1:26-cv-04343, in the Eastern District of California. Picayune, owner of the Chukchansi Gold Resort and Casino in Coarsegold, filed it on 5 June against the NIGC, its chair, North Fork, Station Casinos and Red Rock, and moved for a preliminary injunction and stay on 28 August. After two resets, that motion and motions to dismiss from North Fork and the Station entities were argued on 9 October and taken under submission. The NIGC has answered the complaint and opposed the injunction.

What Picayune Wants Set Aside

The amended complaint seeks an order setting aside the NIGC chair's approval of the management contract under the Administrative Procedure Act, a declaration that without a valid governor's concurrence the site does not qualify for the Indian Gaming Regulatory Act's two-part determination exception, and preliminary and permanent orders "enjoining all unlawful gaming" on the parcel. It alleges North Fork has been moving slot machines onto the site since the state judgment became final.

The argument runs through California law. For land taken into trust after 1988, IGRA's two-part determination exception needs the Interior Secretary to find a casino in the tribe's interest and not detrimental to the community, which happened in 2011, and the governor to concur, which Governor Jerry Brown did in 2012. The Legislature ratified the tribe's compact in 2013; voters rejected it through Proposition 48 in November 2014. On 16 December 2025 California's Fifth Appellate District held that the vote rendered the concurrence "void ab initio", and the California Supreme Court denied review on 1 April 2026. "North Fork is bound by a final judgment, and North Fork cannot run away from it," Picayune has said, as quoted by G3 Newswire.

North Fork's answer is that the federal approvals stand on their own. After the referendum and a court-ordered mediation, the Interior Department issued Secretarial procedures authorising Class III gaming on 29 July 2016, which the Ninth Circuit upheld against a Johnson Act challenge in 2020. At the hearing North Fork's lawyer Christopher Babbitt said the federal government had found the site met the two-part determination at least two years before the referendum, and that "enough is enough", according to The Fresno Bee. Station called the case an "eleventh-hour lawsuit recycling previously rejected arguments" in its motion to dismiss, the Bee reported, while Picayune has told the court its casino could lose up to 50% of its gaming revenue.

The State Court Itself Said the Federal Question Was Open

Picayune's strongest card is a final state judgment, but the opinion behind it was careful about its reach. The Fifth District said North Fork's arguments "present questions of federal law for which there is no direct precedent" and declined to treat the dispute as moot for that reason, not because it had answered them. That is now Judge Sherriff's question: whether a concurrence California treats as void from the start can still satisfy IGRA when federal agencies relied on it at the time. A preliminary injunction needs Picayune to show a likely win on that unprecedented point, plus irreparable harm, with the opening nine days away. The revenue claim goes to harm; the novelty of the law cuts the other way. Scope matters too: Red Rock lists "additional Class II" machines, while the complaint's IGRA claim is framed around Class III gaming.

Red Rock's Money Is Mostly at Risk After Opening, Not Before

Construction is financed through the tribe's $750 million credit facility. Station's completion guaranty is capped at $425 million, and Red Rock says it is not probable that it will be needed. What is still owed to Station, $83.4 million in unrecognised advances at 30 June plus the 4% development fee due on opening day, depends on the casino opening and trading. The construction debt sits with the tribe, so a short delay mainly defers Station's fees and recoveries. The Native American segment produced $3.8 million of Red Rock's $510.3 million second-quarter revenue: a delay is a nuisance, but a ruling that voids the seven-year management contract would be a different order of problem.

California's Off-Reservation Casinos Are Being Decided in Federal Court

In Vallejo, the Scotts Valley Band of Pomo Indians opened a casino that lasted six days before Interior found the land ineligible: a finished building and an opening date do not settle eligibility. Federal judges are also deciding what counts as Class III gaming on tribal land. For Red Rock, already facing an order to bargain with a union in Las Vegas, North Fork is its entire Native American segment and its only reported business outside Las Vegas.

North Fork has built the casino and named the night. Whether it opens as planned depends on one federal judge's answer to a question no court has yet decided.
