Summary

Djibouti licenses land-based casinos and a lottery concession but prohibits online gambling unless a competent authority authorises it, and no online authorisation regime has yet been published. The Digital Code, signed on 6 July 2025, bans games of money and chance of every kind organised over an electronic network or computer system, including knowledge-based games, save with authorisation (article 640). Organisers face up to three years' imprisonment and a fine of up to DJF 35 million, doubled for organised gangs, and players face up to three years or the same fine (articles 642 and 643). Online advertising for illicit gambling carries a fine of up to DJF 140 million (articles 646 and 647). Article 640 requires a Council of Ministers decree, proposed by the ministry for the digital economy, to set the authorisation conditions; none was found in the Official Journal. Offline, Law 39/AN/83 of 19 March 1983 allows casinos by presidential arrêté on a book of conditions, admits only over-18s with an admission card, and takes a 30% levy on gross gaming product for the national budget. Slot machines are banned except in four-star hotel casinos (Law 83/AN/95). The last casino authorisation found, for Leisure of Africa at the Kempinski hotel, was renewed in October 2018 for two years, and the MENAFATF mutual evaluation of November 2024 counted one casino in 2023. Lotteries need an authorisation paying the State at least 10% of gross receipts (Ordinance 87-0029), and a 2003 arrêté gave the lottery concession to the Société Djiboutienne des Jeux. There is no dedicated regulator: the Ministry of the Interior proposes casino authorisations and supervises casinos for AML purposes.

Common pitfalls

Treating Djibouti as unregulated online: since July 2025 the Digital Code prohibits online gambling without authorisation and makes players liable, and the decree that would allow authorisations has not been published. Reading the 1983 casino law as an online route: it authorises premises open to the public. Relying on Arrêté 93-0135 for slot machines outside casinos: Law 83/AN/95 later banned them outside four-star hotel casinos. Citing the gaming law by the numbers used in some later texts (39/AN/53 or 30/AN/83): the Official Journal record is Law 39/AN/83/1ère L of 19 March 1983.

Outlook

The item to watch is the Council of Ministers decree under Digital Code article 640, which would set how, and by whom, online gambling can be authorised; none had been published in the Official Journal by 23 September 2026. On the land-based side, the MENAFATF evaluation of November 2024 reported a high risk rating for gaming establishments and found casino customer identification unsystematic, so follow-up on that evaluation may bring closer Ministry of the Interior supervision of casinos under the AML law as amended in 2025.

Frequently asked questions

Only with an authorisation, and none can yet be obtained.
