West Virginia is small, early and structurally unusual, and the structure is the reason to read it. Online casino and poker were authorised under the West Virginia Lottery Interactive Wagering Act, at Article 22E of the state code, and the drafting is the distinctive part: interactive wagering is treated as West Virginia Lottery games, owned by the state and run through licensed gaming facilities. The operator is delivering a lottery product rather than holding a casino licence in its own right. That framing is not merely technical. Routing online gambling through the lottery gave the state a constitutional and political footing it might not otherwise have had, and it is a model other small states have looked at when their casino industry is too limited to anchor an online market the way Atlantic City does in New Jersey. The West Virginia Lottery Commission oversees the market and the state collects 15% of adjusted gross interactive wagering receipts, which is at the low end nationally and a deliberate contrast with Pennsylvania next door. Volumes are modest because the population is, so West Virginia matters as a design precedent rather than as a revenue story. It demonstrates that a state does not need a large land-based industry to run a functioning online casino market, provided it is willing to own the product.

West Virginia is a smaller but fully live iGaming market with a competitive 15% tax rate. Its statutory model, running online casino as lottery games through licensed casinos, is a template other states weigh against the New Jersey casino-licence model.
Adjusted EBITDA of €162.5 million, a third guidance upgrade this year, and North American revenue up 161%. The driver is a motor-racing and slot hybrid running with Hard Rock Bet in Florida that settles on historical race results rather than a random number generator, and Playtech is telling investors not to annualise it.
The operator's own state list now reads 18, and West Virginia is the addition. It is one of only a handful of states where the casino product can travel with the sportsbook.
FanDuel, DraftKings and Caesars all walked away from the category this year and it sat vacant through the summer. Fanatics has taken it on a non-exclusive deal, and the reason the others left has not gone anywhere.
A report commissioned by the Campaign for Fairer Gambling estimates that unlicensed online gambling operators generated $97.4 billion in US revenue in 2025, growing at nearly twice the pace of the regulated sector and raising pointed questions about whether legalisation is containing or expanding overall market harm.
