Summary

Colombia regulates online gambling through the state monopoly on games of chance set by Law 643 of 2001. Since Law 1753 of 2015 rewrote article 38, every game operated over the internet is a novedoso game that a company may offer only under a concession contract with Coljuegos, the state enterprise attached to the Ministry of Finance. One contract covers sports and event betting, slots and table games, poker, bingo, virtual games, live casino and approved instant-prize games, on a single .co domain, for three to five years. In August 2026 Coljuegos listed 14 authorised operators, and in November 2025 about 1.9 million players placed bets with them. The operator pays exploitation rights of 15% of gross revenue less prizes, a fixed 811 monthly minimum wages a year and a 1% administration fee, all earmarked for health; players pay 20% tax on winnings, withheld by the operator. VAT is the live issue. A 19% VAT on deposits applied from February to December 2025, and Coljuegos linked it to a 17% fall in its online collections that year. A second decree taxing online GGR in 2026 was struck down by the Constitutional Court; instead, Decree 240 of March 2026 charges a 16% national consumption tax on online gaming revenue until the end of 2026, and a government tax reform bill before Congress since July 2026 proposes 19% VAT again. Coljuegos also regulates advertising in detail, caps advertising spend, and publishes a blocklist of more than 62,000 unauthorised sites.

Common pitfalls

Treating the Coljuegos concession as a licence that can be held from abroad: it requires a Colombian company or branch and a single .co domain. Reading the 15% as a tax on profit: it is 15% of gross revenue less prizes, plus a fixed 811 monthly minimum wages a year, and it rises to 17% of gross revenue for a game whose return to player falls below 83%. Assuming VAT applies today: online games are excluded from VAT, but that has been reversed twice by temporary decree and a bill to tax them is before Congress.

Certification requirements
The gaming system and each game must be certified against the Coljuegos technical requirements by a laboratory authorised by Coljuegos, and a central gaming unit must record every transaction (Acuerdo 08 de 2020, arts. 1.6.1 to 1.6.3). Coljuegos publishes the list of accredited laboratories.
Barriers to entry
The applicant must be a Colombian company or the Colombian branch of a foreign company, registered for economic activity 9200, lasting at least two years beyond the contract (Resolution 20161200025334, art. 5). Financial tests: working capital of at least 1,450 SMMLV, debt no higher than 70% of assets, interest cover of at least 1.1, and equity of at least 30% of the fixed exploitation rights and fees for the whole contract. A Colombian bank account must hold player balances in full, and documents must be in Spanish.

Prizes from lotteries, raffles, bets and similar are occasional gains taxed at 20% (Estatuto Tributario, arts. 304 and 317). The online operator withholds the tax when the player withdraws funds (Acuerdo 08 de 2020, art. 1.5.5, para. 2).

VAT treatment
Games of chance operated exclusively over the internet are excluded from VAT (Estatuto Tributario, art. 420 (e)). Decreto Legislativo 175 de 2025 applied 19% VAT to player deposits from 22 February to 31 December 2025; Decreto Legislativo 1474 de 2025 would have taxed online GGR at 19% for 2026 but was suspended on 29 January 2026 and declared unconstitutional on 15 April 2026. Instead, for 2026 Decreto Legislativo 0240 of 12 March 2026, issued under the economic emergency declared by Decreto 150 of 11 February 2026, created a national consumption tax (impuesto nacional al consumo) of 16% on online games of chance: the taxable event is each player deposit, the base is gross gaming revenue (stakes less prizes paid) in each two-month period, and the online operator is liable (Estatuto Tributario arts. 512-1 num. 4 and 512-22, as added for 2026). It applies until 31 December 2026.

Exploitation rights (derechos de explotación) paid monthly to Coljuegos at 15% of gross revenue less prizes paid, per game type, for games with a return to player of at least 83% (Ley 643 de 2001, art. 38; Acuerdo 08 de 2020, arts. 1.1.5 and 1.1.10). Central monitoring system
Operators must keep a central gaming unit that records every game operation and account event and allows full reconstruction, and store data in the Coljuegos inspection system in line with its data model (Acuerdo 08 de 2020, arts. 1.4.2 and 1.6.2).
KYC requirements
One account per player, opened before play with identity data, age, address, email and a declaration that no prohibition applies (Acuerdo 08 de 2020, art. 1.5.2). The operator must verify the data within 30 working days, and withdrawals are allowed only after verification; data must be updated yearly. Accounts inactive for six months are suspended. Players must be resident in Colombia.
Stake limits
Minimum and maximum stakes are set by the operator in each game's rules (Acuerdo 08 de 2020, art. 1.5.11).
Mandatory player messaging
A permanent responsible-gambling notice defined by Coljuegos in the game interface, the Coljuegos message that minors may not play, and the "Autoriza Coljuegos" seal with the contract number and end date on the site (Acuerdo 08 de 2020, arts. 1.5.1 and 1.7.2).
Reporting obligations
Monthly declaration and payment of exploitation rights within the first ten working days of the following month, with players' municipality of residence; an annual report within 25 working days on accounts, deposits, withdrawals, bets, prizes, bonuses, advertising spend and costs (Acuerdo 08 de 2020, arts. 1.1.7 and 1.1.9); an annual advertising investment plan and, by 31 January each year, a description of the operator's risk-detection protocol and the number of at-risk players detected in the previous year (Resolution 20231000019054, arts. 7 and 16).

Sponsorship rules
Operators may sponsor professional teams in any discipline within the advertising spend cap, and professional teams may sign advertising deals only with Coljuegos-authorised operators (Resolution 20231000019054, art. 11).
Celebrity and influencer rules
No rule specific to influencers in the resolution; social media advertising by operators or third parties is limited to networks with tools to keep it from minors (art. 15). Coljuegos fined a content creator COP 116 million in August 2026 for running an unauthorised promotional game on Instagram; the decision can still be appealed.
Social media rules
Email and other electronic marketing needs the recipient's consent and may not go to self-excluded players, people under judicial support measures or players flagged as at risk (arts. 12 and 13). Video platforms and social networks may carry operator advertising only if they can keep it from minors, let users block adverts, and run periodic responsible-gambling messages (arts. 14 and 15).
Bonus advertising rules
Bonuses and promotions are allowed if their conditions and validity periods are published and they do not alter the game or confuse players (Acuerdo 08 de 2020, art. 1.7.1). Advertising must be informative, and cash prizes may not be offered in promotions, only prizes in kind (Resolution 20231000019054, art. 10).
Mandatory warnings
Advertising must warn of the risk of gambling addiction and carry a responsible-gambling message and a notice that play is limited to adults (Acuerdo 08 de 2020, art. 1.7.1).
Penalties for breach
A breach is a contractual default, with a fine of 1.5% of the concession contract value; a third breach allows unilateral termination (Resolution 20231000019054, art. 9). Anyone who advertises illegal gambling faces Coljuegos sanction proceedings.

Administrative penalties
Illegal operation of games other than localised games: fine of 100 SMMLV where operated by authorisation, or 300 SMMLV where operated directly or by concession, per establishment, point of sale or seller, with a five-year ban. Undeclared exploitation rights: 200% of the amount due; inaccurate declarations: 160% of the difference (Ley 643 de 2001, art. 44).

Coljuegos must refer illegal operation to the criminal authorities (Ley 643 de 2001, art. 44). The offence itself is in the Criminal Code, which was not reviewed.
Operator liability

Outlook

The decisive question for the next twelve months is VAT. The 16% national consumption tax on online games under Decree 240 of 2026 runs only until 31 December 2026. The government's tax reform bill, before Congress since July 2026, would tax online and physical betting at 19%; the two previous financing bills failed to pass, and the Constitutional Court struck down the 2026 emergency decree that tried the same. Coljuegos has also reported draft changes to its 2023 advertising resolution and to the technical annex for online games, and approved new instant-prize game rules in May 2026. Several five-year concessions signed in 2020 have been renewed or have ended, so the operator list is worth checking against the Coljuegos register.

Primero Buys Win Systems' Gaming Division and 3,000 Positions in Latin America

The Georgia manufacturer has bought the gaming operations arm of Win Systems, including its Gold Club electronic-roulette business, taking on an installed base across Mexico, Peru, Colombia, Puerto Rico and Panama. Terms were not disclosed, and the deal turns a US regional supplier into a Latin American one overnight.
