Summary

Missouri legalised sports wagering by constitutional amendment rather than by statute. Amendment 2, approved by voters on 5 November 2024, added Article III, Section 39(g) to the state constitution, and betting opened on 1 December 2025. The Missouri Gaming Commission, part of the Department of Public Safety and the regulator of the state's riverboat casinos since 1993, licenses operators under 11 CSR 45-20. Mobile licences are tied to casino owners or professional sports teams, plus two issued directly to operators through a competitive round; the Commission picked DraftKings and Circa for those in August 2025. Eight mobile operators and eight casino sportsbooks reported wagering in July 2026. A mobile licence costs $500,000 and a retail licence $250,000, each for five years. Players must be 21 and physically in the state. The tax is 10% of adjusted gross revenue, which deducts promotional credits up to 25% of monthly receipts, federal excise tax and limited bad debt. After the Commission's costs, the greater of 10% of the tax or $5 million goes to the Compulsive Gaming Prevention Fund and the rest to education. In the seven months to June 2026 bettors staked $2.32 billion and licensees reported $60.0 million of taxable revenue and $9.6 million of tax. Online casino and poker are not authorised, and the Commission calls online casinos illegal. Daily fantasy sports is licensed separately under RSMo 313.900 to 313.955, from age 18. In September 2026 the Attorney General told six prediction market operators, among them Kalshi and Polymarket, to stop offering sports event contracts in Missouri or obtain a Commission licence within 30 days.

Common pitfalls

Reading the Commission's "taxable AGR" as gross gaming revenue: it is after promotional credits (up to 25% of monthly receipts), federal excise tax and other deductions, so the 10% rate is not comparable with a state that taxes gross revenue. The tax reported also does not equal 10% of the statewide total, because it is calculated licensee by licensee and a negative month produces no tax for that licensee. Assuming a sports betting licence covers online casino: the constitution authorises sports wagering only, and the Commission calls online casinos illegal. Assuming college props are banned: only props on individual athletes in games involving a Missouri college team are barred. Treating fantasy sports as sports wagering: fantasy contests are licensed under a separate statute from age 18. Assuming revenue-share affiliate deals are allowed: payment tied to wagering volume or outcome is prohibited.

Certification requirements
All sports wagering equipment and systems must be tested and certified by a Commission-licensed independent testing laboratory and approved by the Commission before use, and the system must be recertified at least every 12 months; temporary approval is possible for systems approved in a similar jurisdiction (11 CSR 45-20.240). Mobile licensees must use commercially reasonable geolocation and geofencing (Mo. Const. art. III, s.39(g)12) and contract with a Commission-licensed integrity monitoring provider (11 CSR 45-20.180).
Barriers to entry
A mobile licence must come through a Missouri excursion gambling boat owner or a professional team in the NFL, MLB, NHL, NBA, MLS, WNBA or NWSL, or through one of only two direct licences; the Commission describes the constitution as allowing 19 retail and 14 mobile licences. Applicants and key persons with any felony or gambling conviction are barred (s.39(g)5). Other costs are the $500,000 fee, the $500,000 minimum reserve and background checks on key persons. Eight mobile operators reported wagering in July 2026.

One per excursion gambling boat owner (a group owning several boats may use only one operator under it) and one per professional sports team, held by the owner, team or its designated sports wagering operator (Mo. Only two may be issued, by competitive application judged on expertise, platform integrity, experience, advertising plans, revenue potential, responsible gaming and capacity to grow bettors (Mo. Const. art. III, s.39(g)4.c; 11 CSR 45-20.050). The Commission selected DK Crown Holdings and Circa Hospitality Group I for priority investigation in August 2025 and granted both mobile licences on 29 April 2026.

Internal controls must include procedures for federal cash transaction reporting, including detection of structuring across multiple wagers in 24 hours, and suspicious activity reporting on both financial and wagering activity (11 CSR 45-20.390); retail licensees must ensure Currency Transaction Reports are completed for all reportable transactions (11 CSR 45-20.550(16)). Licensees must report abnormal and suspicious betting to the Commission and sports governing bodies (Mo. Const. art. III, s.39(g)9.f) and use a licensed integrity monitoring provider (11 CSR 45-20.180). A Level I occupational licence is required for the employee responsible for responsible gaming, geofencing and anti-money laundering compliance.

Deposit limits
Platforms must let patrons set daily, weekly or monthly deposit limits; a stricter limit takes effect immediately and a looser one only after the current limit period ends (11 CSR 45-20.580(2), (3)).
Session limits
Patrons must be able to set daily, weekly or monthly time limits and to suspend their account for between 72 hours and one year; no sports wagering marketing may be sent during a suspension (11 CSR 45-20.580).
Data localisation
The servers that receive and confirm wagers must be in Missouri or at another location the Commission approves consistent with federal law (Mo. Const. art. III, s.39(g)11). The Commission may approve US-based cloud storage for duplicated backup data (11 CSR 45-20.220(18)).
KYC requirements
To open an account the mobile licensee records legal name, date of birth, the last four digits of the Social Security number (or a passport or taxpayer number for a foreign patron), residential address (not a PO box), email and phone, and whether the patron is an athlete, official, coach or team employee. Identity is verified by remote multi-source authentication, which may include third-party or government databases and examination of a valid government photo ID; multi-factor authentication is required on each new device. The licensee must confirm the patron is 21 and not on the List of Self-Excluded Persons or the Commission's Excluded Persons List, and allow only one account per patron (11 CSR 45-20.320).
Stake limits
Patrons must be able to set per-wager and total wager limits on a daily, weekly or monthly basis (11 CSR 45-20.580(2)).
Mandatory player messaging
Platforms must link to responsible gaming information and the Commission's SEP List application (11 CSR 45-20.580(8)); account statements must say how to get help with gambling problems (.320(12)); retail sites must post help and 21+ signs. Advertising must state the 21 age limit and prominently show compulsive gaming help information (.570(11)).
Reporting obligations
Monthly tax remittal through the Commission's system by the 15th of the following month (11 CSR 45-20.540); written notice within 24 hours of discovering a prohibited wager (.360(7)); notice within 48 hours of a reserve shortfall (.190); reports of abnormal and suspicious betting to the Commission and governing bodies; notice of ownership issuances of 10% or more in advance (.110). The Commission publishes monthly handle, taxable revenue and tax by licensee.
Game content restrictions
Wagers only on events and wager types the Commission has approved in its catalog. No wagers on youth or high school events, events where most participants are under 18, or fantasy contests, and no wagers on the individual performance of athletes in a college game involving a Missouri college team (11 CSR 45-20.360(2); Mo. Const. art. III, s.39(g)16.k). The Commission refused the NCAA's January 2026 request to ban collegiate player props and first-half under spreads more widely.

Licensees are responsible for all advertising done on their behalf or to their benefit, including by affiliated entities and third parties under contract (11 CSR 45-20.570(7)). They may not pay a third party for advertising or marketing on terms that depend on the volume or outcome of wagers rather than the number of patrons acquired, which rules out revenue-share affiliate deals (.570(12)).
Sponsorship rules
Professional sports teams and governing bodies may enter commercial agreements with operators, including sharing in amounts wagered on their events, without a Commission licence (Mo. Const. art. III, s.39(g)7.c). Advertising within a sports district requires the resident team's approval (s.39(g)9.m).
Celebrity and influencer rules
No celebrity or entertainer endorsements designed to appeal specifically to under-21s, no one who is or appears to be under 21, and no placement on social media that appeals primarily to under-21s (11 CSR 45-20.570(11)(D) to (F)).
Social media rules

Bonus advertising rules
Written, dated rules for each promotion that are full, accurate and clear; material terms, including the cost to take part, placed close to the headline claim in a reasonably prominent size; offer records kept for five years stating dates, eligibility, withdrawal restrictions, wagering requirements, the order in which funds are used, eligible events and cancellation rules (11 CSR 45-20.570(3) to (6)).
Mandatory warnings
A statement that patrons must be 21 or older, and prominent compulsive gaming help information such as a toll-free helpline or problem gambling website (11 CSR 45-20.570(11)(B), (C)). Commission materials give 1-888-BETSOFF and 1-800-GAMBLER.
Penalties for breach
Fines of up to $50,000 per violation or $100,000 for violations arising from the same occurrence, probation, suspension or revocation of the licence (Mo. Const. art. III, s.39(g)9.k; 11 CSR 45-20.150).

Restrictions

  • Operators must use commercially and technologically reasonable means to ensure advertising does not purposefully target people under 21 or self-excluded people, is not false, misleading or deceptive, and clearly discloses the material terms of any promotion, with a link or location for the full terms (Mo. Const. art. III, s.39(g)14; 11 CSR 45-20.570(10)).
  • All advertising must state that patrons must be 21 or older and prominently display compulsive gaming help information such as a helpline or website (11 CSR 45-20.570(11)(B), (C)).
  • No images, symbols, celebrity or entertainer endorsements or language designed to appeal to under-21s, no one who is or appears to be under 21, and no placement in media, including social media, that appeals primarily to under-21s or before audiences presumed to be mostly under 21 (.570(11)(D) to (G)).
  • Advertising must not imply better chances of winning than with other licensees or from betting more, and must not call promotional credits "free" if monetary conditions apply (.570(11)(H) to (J)).
  • Promotions may not be described as risk-free if the patron must risk their own money, and may not restrict withdrawal of the patron's own funds or winnings from them (.570(3)).
  • Direct marketing must offer an unsubscribe option; self-excluded people must be removed from marketing and reward programmes, and patrons on a temporary account suspension may not be sent sports wagering marketing (.570(11)(K), .600(6), .580(7)).
  • Sports wagering promotion and advertising within a sports district needs the approval of the professional team that plays its home games there (Mo. Const. art. III, s.39(g)9.m).
  • Licensees must keep all advertising and marketing materials and a publication log for five years and give them to the Commission on request (.570(8), (9)).

Winnings must be credited within 24 hours of the official result, and a verified withdrawal request honoured within five business days unless the licensee suspects fraud or unlawful conduct, in which case it must notify the patron, investigate promptly and report confirmed fraud to the Commission (11 CSR 45-20.320(7), (14)). Balances on a closed account are refunded within five business days. Sports wagering: fines of up to $50,000 per violation or $100,000 for violations from the same occurrence, probation, suspension or revocation, with appeal to the circuit court; fines may also be imposed on anyone required to hold a licence who does not (Mo. Outlook

The Attorney General's letters give the six prediction market operators 30 days to comply (the Kalshi letter is dated 16 September 2026) and say failure will lead to enforcement action, so a court test of the state's position is possible from mid-October 2026. On 23 September 2026 the Commission licensed Caesars Sportsbook's mobile operation and its two casino sportsbooks (Resolutions 26-068 to 26-070). Fiscal year 2027 reports will give the first full year of figures; July 2026 alone produced $246.8 million of handle and $2.19 million of tax. The constitution requires the State Auditor to audit sports wagering revenues every year. Two 2026 House bills on gaming and the Commission, HB 2989 and HB 3533, did not pass before the session ended in May 2026.

Frequently asked questions

What is the sports betting tax in Missouri?
10% of adjusted gross revenue under Article III, Section 39(g) of the constitution. Adjusted gross revenue deducts winnings, promotional credits up to 25% of monthly cash receipts, federal excise tax and limited bad debt, and negative months are carried forward.
Who regulates sports betting in Missouri?
The Missouri Gaming Commission, part of the Department of Public Safety, which also regulates the state's riverboat casinos and fantasy sports contests. The Attorney General enforces the law against unlicensed operators.
How do operators get a mobile licence and what does it cost?
Through an excursion gambling boat owner or a professional sports team, or through one of two direct licences awarded competitively, which the Commission gave to DraftKings and Circa. A mobile licence costs $500,000 for five years and is renewable for the same fee; operators must also keep a reserve of at least $500,000.
Are online casino and poker legal in Missouri?
No. The constitution authorises sports wagering only, the Commission says online casinos are illegal, and gambling outside what the law authorises is an offence under RSMo 572.020.
Can prediction markets offer sports contracts in Missouri?
Not in the Attorney General's view. In September 2026 the office told Polymarket, Kalshi, Crypto.com, Novig, Underdog and Robinhood that sports event contracts are unlicensed sports wagering and that they must stop or obtain a Commission licence within 30 days. No court has ruled on that position in Missouri.
How large is the market?
In the seven months from launch to June 2026 bettors staked $2.32 billion; licensees reported $60.0 million of taxable adjusted gross revenue, $57.2 million of it online, and $9.61 million of tax, according to the Commission.
